The Los Angeles County Bail Bonds Process
When someone is arrested in L.A. County, they will often be first taken to a local police station to be booked. If, however, the local jail is full or if you delay too long, the arrestee will likely be transferred to Men’s Central Jail or (for women) to the Century Regional Detention Facility. These facilities are much larger and busier than local jails, and their booking, bail-posting, and release processes can take as long as 24 hours.
Booking involves a number of elements, including scanning the suspect’s fingerprints on a LiveScan machine, which does a background check against the DOJ national database. Official charges will be registered against the arrestee, a mugshot taken, temporary confiscation of the arrestee’s personal possessions, and unless he is bailed out very quickly, an exchange of the clothes he has on for jail clothes.
Posting Bail
The bail amount will be set by a judge at a bail hearing. The amount will be based on the nature of the allegations and the defendant’s past criminal history. The judge will use the county bail schedule as a guide, but he/she will have great discretion. A judge can even deny bail for capital crimes and whenever he deems the defendant to be a high “flight risk.”
Once the booking process is complete, we can post bail immediately. But again, in Los Angeles, it can take up to 24 hours to be booked. This underscores the importance of getting the process started as early as possible. We can get the paperwork ready in less than an hour. And we can use our intimate knowledge of L.A. County jail procedures to minimize the time involved. However, we can only post bail after booking is complete, and the jailer will then need to verify the paperwork and begin the release process.
How Bail Bonds Work
A bail bond is a surety bond that binds the bail bonds agency to make good on the full bail amount should the defendant fail to appear in court. It also binds the co-signer to reimburse the bail bonds agency should the bail money thus be lost. A premium, usually of 10%, is paid as a fee to the agent for his services. In this way the arrestee is able to get out of jail without having to come up with the full bail money in cash or cash equivalent.
Most bail bonds agencies will require some form of collateral to secure the 90% of the bail not covered by the fee. This could consist of real estate deeds, automobile titles, expensive jewelry, bank accounts, or other valuables. At Gotta Go Bail Bonds, we offer reasonable financing plans to those who cannot afford the 10% premium. We do all we can to work with you to ensure you can bail your loved one out of jail.
Once your loved one is released from jail, he will be required to appear for all court hearings and to follow all other court-imposed terms of bail. He will also have to keep in contact with his bail bonds agent and report to him any changes of address, employment, or contact information.
